Overview
We are seeking a highly skilled Litigation Lawyer specializing in consumer flight claims to lead in-court collections, owning or wanting to open a boutique Legal Firm in Italy. Pre-court collections are managed by a team of paralegals. You will be responsible for filing batches of court cases to collect compensation and / or reimbursement of Out-of-Pocket Expenses (OPE) incurred by passengers and / or recover ticket refunds. The role requires being free from conflicts of interest to litigate claims against different airlines. This position is part of AirAdvisor, a startup focused on protecting air passenger rights globally.
Please attach a simple Word document describing your experience in airline passenger claims under EU261 / 2004 or baggage claims under the Montreal Convention, in English, rather than a CV. You must hold a valid Attorney at Law license in Italy and be authorized to practice law by the Regulation Authority in Italy.
Only candidates with the legal qualifications and availability to perform in a remote-first environment will be considered. In June 2025 we launched a new baggage-claims service for lost, delayed, or destroyed luggage. We operate in the EU, UK, and other international markets, with a goal of expanding to more jurisdictions.
Requirements
- A valid Attorney at Law license in Italy and professional liability insurance.
- A law degree from an accredited institution.
- Experience with small claims, consumer rights, or aviation law is a plus but not required.
- Knowledge of relevant consumer protection laws and aviation regulations is a plus but not required.
- Proven track record of success in in-court collection.
- Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective legal strategies.
- Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations.
- Experience in automating and standardizing claims management processes to scale up quickly.
Responsibilities
- Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction.
- Pre-court collections and out-of-court settlements.
- Prepare and file batches of approximately 200+ new claims monthly in Italian courts against various airlines for recovering: a) compensation under EU Regulation 261 / 2004 and / or Turkish SHY Regulation for delays, cancellations, and denied boarding; b) reimbursement of out-of-pocket expenses under EU261 / 2004 and / Montreal Convention; c) ticket refunds owed to passengers; d) baggage-related claims under the Montreal Convention and / or Warsaw Convention.
- Respond comprehensively to airline defenses, including substantive arguments as well as procedural and jurisdictional challenges.
- Lead the enforcement of court judgments and coordinate with bailiffs or enforcement authorities when necessary.
- Engage in court-led settlement negotiations and represent AirAdvisor’s interests in favorable in-court settlements where applicable.
- Maintain complete and accurate legal case files, ensure compliance with Italian legal ethics, data protection regulations, and professional standards; conduct thorough legal research and analysis to manage recurring legal issues in airline and consumer rights litigation.
- Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and judicial precedents to provide updated legal advice and representation.
- Where applicable, pursue legal remedies, including appeals, and advocate for legislative changes if feasible.
- Support optimization and automation of claims-management workflows using legal technology, including AI-based tools, to improve efficiency and scalability.
- Identify and propose new civil-claims opportunities viable under Italian law with low-value, high-volume potential; areas may include bank disputes, labour-law-related claims, and cross-jurisdictional research across EU and UK markets for precedents applicable in Italy.
- Represent AirAdvisor in local media and coordinate with the PR Manager to leverage public-relations opportunities around landmark rulings or key legal developments.
- Review and vet content as needed to build local trust and authority.
- Advocate for passenger and consumer rights within the airline and travel industry.
